On 28 March 2022, the Presidents of the Employment Tribunals in England and Wales and in Scotland issued the Fifth Addendum to the Presidential Guidance on employment tribunal awards for injury to feelings. The Addendum outlines the following updates to Vento bands which have been adjusted to take account of the RPI measure of inflation:
•A lower band of £990 to £9,900 for less serious cases.
•A middle band of £9,900 to £29,600 for cases which do not merit an award in the upper band.
•An upper band of £29,600 to £49,300 for the most serious cases.
•Amounts in excess of £49,300 can be awarded in the most exceptional cases.
The Addendum notes that, in respect of claims presented in Scotland, the bands remain subject to paragraph 12 of the Presidential Guidance as originally issued on 5 September 2017, which concerns whether the Simmons v Castle uplift should apply in Scotland.
The new bands will apply to claims presented on or after 6 April 2022.
