Recommendations on time limit for bringing claims and increasing limit on breach of contract

The Law Commission has published a report ‘Employment Law Hearing Structures’ which makes a number of recommendations for changes to the powers and jurisdiction of employment tribunals: including:

  1. Enlarging employment tribunals’ jurisdiction to include breach of contract claims during employment (currently they can only be brought after employment has ended);

  2. Increasing the limit on breach of contract claims to £100,000 (currently £25,000); and

  3. Extending the time limit for issuing all employment claims to six months (most are currently three months plus extra depending on the ACAS Early Conciliation Process).
