Holidays continue to accrue between dismissal and re-instatement

When an individual wins a claim for unfair dismissal then can claim compensation only, or re-instatement (to their old job) or re-engagement (to another job with the same employer).

The Advocate General has confirmed that employees re-instated or re-engaged are entitled to be paid for holidays (as well as lost earnings and benefits) for the period from the date of their dismissal to going back.
