Can employment judgments be removed from the online register?


Since February 2017, the Government established an on-line register of employment law judgments. This can be particularly useful for employers and prospective employers to check previous decisions against individuals. You can access it here: www.gov.uk/employment-tribunal-decisions

An individual recently applied for a claim to be taken offline and for an anonymity order. The claim referred to a preliminary hearing judgment, which was critical of her behaviour at an earlier preliminary hearing. Both applications were refused. Despite the fact the record of the proceedings might be “painful, humiliating or deterrent”, did not mean that it should not be made public. A tribunal only has limited powers in relation to national security cases.
