Addison Lee appealed an employment tribunal’s decision that a courier cyclist was a worker, and not genuinely self-employed, and thus was entitled to paid holidays.
The main question was whether there was a mutuality of obligation between the parties when the courier was logged onto the company’s app. The Employment Appeal Tribunal held there was. Once logged onto the app, the courier had to accept jobs offered to him. The fact that he was entitled to log off at any time did not affect his obligation while logged on.
