Furlough: Urgent clarification sought from the Government on outstanding areas of conflict

The Employment Lawyers Association Covid-19 Working Party has published a paper urging the Government to clarify, as a matter of urgency, the areas of conflict identified within the current versions of the guidance on the Coronavirus Job Retention Scheme (CJRS).

Following the recent guidance, a number of questions remain outstanding and new ones have arisen in relation to:

  1. Collective redundancies.

  2. Annual Leave.

  3. Obtaining adequate consent to vary the employment contract.

  4. Protection against redundancies, dismissals and failure to provide work under zero hours contracts.
