Father discriminated for less shared parental leave pay

January 11, 2017

Network Rail was held to have discriminated against a father who was only entitled the statutory level of pay, while his wife, who also worked for the company, was entitled to enhanced pay.

The father is reported to have been awarded just over £28,000 and Network Rail has changed its policy so that only statutory amounts are paid to both men and women during shared parental leave.  The case highlights the importance of employers who offer enhanced payments to one sex, to make sure they are reflected to the other sex to avoid being liable for discrimination.
